In exchange for participation in the activities organized by Harmony Lane Studios, Poland, Ohio, 44514 and/or use of the property, facilities and services of Harmony Lane Studios, I agree for myself and (if applicable) for the members of my family, to the following: 

 

1.AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules andwarnings, and further agree to follow any oral instructions or directions given by Harmony LaneStudios, or the employees, representatives or agents of Harmony Lane Studios.

 

2.ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risksassociated with the above described activity and I assume full responsibility for personal injury tomyself and (if applicable) my family members, and further release and discharge Harmony LaneStudios for injury, loss or damage arising out of my or my family's use of or presence upon thefacilities of Harmony Lane Studios, whether caused by the fault of myself, my family, Harmony LaneStudios or other third parties.

3.INDEMNIFICATION. I agree to indemnify and defend Harmony Lane Studios against all claims,causes of action, damages, judgments, costs or expenses, including attorney fees and other litigationcosts, which may in any way arise from my or my family's use of or presence upon the facilities ofHarmony Lane Studios.

 

4.FEES. I agree to pay for all damages to the facilities of Harmony Lane Studios caused by anynegligent, reckless, or willful actions by me or my family.

 

5.MEDICAL AUTHORIZATION. In the event of an injury to the above minor during the abovedescribed activities, I give my permission to Harmony Lane Studios or to the employees,representatives or agents of Harmony Lane Studios to arrange for all necessary medical treatment forwhich I shall be financially responsible. This temporary authority will be in place all activitiesorganized. Harmony Lane Studios shall have the following powers:

•The power to seek appropriate medical treatment or attention on behalf of my child as may berequired by the circumstances, including without limitation, that of a licensed medicalphysician and/or a hospital;

•The power to authorize medical treatment or medical procedures in an emergency situation;and

 

6.APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the aboveshall be resolved under Ohio law.

 

7.ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm'slength negotiation between the Parties. In the event any ambiguity is found to exist in theinterpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitlyreject the application of any legal or equitable rule of interpretation which would lead to a constructioneither "for" or "against" a particular party based upon their status as the drafter of a specific term,language, or provision giving rise to such ambiguity.

 

8.ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whetherstanding alone or as applied to a particular occurrence or circumstance, shall not affect the validity orenforceability of any other provision of this Agreement or of any other applications of such provision,as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part ofthis Agreement.

To the best of my knowledge, I am in good physical condition and fully able to participate in this class. I am fully aware of the risks and hazards connected with the participation in this class, including physical injury, and herby elect to voluntarily participate in said class. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in this class.

I hereby RELEASE, WAIVE, and DISCHARGE the Harmony Lane Studios and its subsidiaries, and affiliates, its officers, directors, representatives, agents, and employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, that may be sustained by me, or to any property belonging to me, while participating in this class, or while on or upon the premises where the class is being conducted.
